Terms of Service

These Terms of Service ("Terms") govern your access to and use of PounceDomains (the "Service"), available at pouncedomains.com. Please read them carefully — by creating an account or using the Service, you agree to them.
1. Agreement to these Terms
By accessing or using PounceDomains (“we,” “us,” or “our”), you agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” refers to that organization. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old and capable of forming a binding contract to use the Service. You are responsible for ensuring that your use of the Service — including bidding on and acquiring domain names — is lawful in your jurisdiction.
3. What the Service does
PounceDomains is a software tool that helps you monitor and bid on domain auctions on the Namecheap Marketplace (the “Namecheap aftermarket”). When you connect your own Namecheap Market account, the Service can, according to the rules and budgets you configure:
- continuously scan ending-soon aftermarket auctions;
- score candidate domains using artificial intelligence across the strategies you select;
- alert you to qualifying matches; and
- place proxy bids on your behalf — either after your approval or automatically, within the limits you set.
We may add, change, or remove features at any time. The Service is a tool; it does not buy, sell, hold, or escrow domain names or funds, and it does not act as a broker, registrar, or auction operator.
4. Your account and third-party connections
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information and keep it up to date.
The Service connects to your own Namecheap Market account using an API key that you generate and provide. You are solely responsible for your Namecheap account, your API key, your account funds, and your compliance with Namecheap’s terms, policies, and auction rules. You may revoke our access at any time by removing your API key in Settings or revoking it on Namecheap.
5. Bidding, auto-bid, and your authorization
Bids placed through the Service are real, binding commitments on Namecheap and may obligate you to pay. By configuring approval or automatic bidding, you authorize the Service to submit proxy bids on the Namecheap aftermarket up to the maximum amounts you specify, on the auctions matched by your rules.
- Approval mode notifies you of a match and places a bid only after you confirm it.
- Auto-bid mode is off by default. When you enable it, it places proxy bids automatically subject to your per-domain maximum, daily budget caps, the global master switch, and dry-run mode.
You are responsible for reviewing and maintaining your bidding configuration. The winning bidder, the final price, auction extensions (Namecheap extends auctions that receive late bids), payment, transfer, and ownership of any domain are all determined and handled by Namecheap — not by us. We do not guarantee that any bid will be placed, accepted, or win, and we are not responsible for amounts you become obligated to pay. You agree that you, and not PounceDomains, bear full responsibility for all bids submitted through the Service and any resulting purchases.
Use auto-bid responsibly, and test before enabling it. Automatic bidding can place bids you did not individually review and can result in the unintended loss of money. Before turning on the auto-bid master switch, you must verify your configuration — including filters, per-domain maximums, and daily budget caps — in dry-run mode. To the maximum extent permitted by law, PounceDomains is not responsible or liable for any bids placed, purchases made, or amounts you are charged as a result of your configuration or the auto-bid feature, including any unintended, duplicate, or erroneous bids. You enable and use automatic bidding entirely at your own risk, and you must explicitly accept these Terms before doing so.
6. AI outputs are not advice
AI-generated scores, reasoning, valuations, and recommendations are provided for informational purposes only, may be inaccurate or incomplete, and do not constitute financial, investment, legal, or professional advice. Domain values are speculative. You are solely responsible for your own decisions about which domains to pursue and how much to bid.
7. Plans, trials, billing, and cancellation
The Service offers a free plan and paid subscription plans with different limits and features. New accounts may include a time-limited trial of a paid plan. Paid subscriptions, when active, are billed in advance on a recurring basis through our payment processor and renew automatically until cancelled.
- You can cancel at any time; cancellation takes effect at the end of the current billing period, and you retain access until then.
- Except where required by law, fees are non-refundable and partial periods are not pro-rated.
- We may change plan features and pricing prospectively, with notice for existing subscribers before a change takes effect.
Fees for the Service do not include any amounts you bid or pay on Namecheap, which are entirely separate and handled through your Namecheap account.
8. Acceptable use
You agree not to:
- use the Service to violate any law or any third party’s rights, including Namecheap’s terms or any auction’s rules;
- bid in bad faith, engage in shill bidding, market manipulation, or fraudulent activity;
- reverse engineer, scrape, overload, or interfere with the Service or its infrastructure, or attempt to access data that is not yours;
- resell, sublicense, or provide the Service to third parties except as expressly permitted; or
- introduce malware or attempt to circumvent security or usage limits.
9. Intellectual property
The Service, including its software, design, and content (excluding your data and third-party data), is owned by PounceDomains and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You retain ownership of the configurations and data you submit and grant us a license to process them to operate and improve the Service.
10. Third-party services
The Service relies on and interoperates with third parties — including Namecheap, AI model providers, email and analytics providers, payment processors, and hosting and infrastructure providers. Your use of those services may be subject to their own terms, and we are not responsible for their availability, acts, or omissions. PounceDomains is an independent product and is not affiliated with, endorsed by, or sponsored by Namecheap.
11. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT IT WILL DETECT EVERY AUCTION, PLACE EVERY BID, OR WIN ANY AUCTION. SCANS AND BIDS DEPEND ON THIRD-PARTY SYSTEMS AND API RATE LIMITS THAT ARE OUTSIDE OUR CONTROL.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, POUNCEDOMAINS AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DOMAINS, OPPORTUNITIES, DATA, OR GOODWILL, WHETHER ARISING FROM MISSED AUCTIONS, UNINTENDED OR FAILED BIDS, AMOUNTS PAID ON NAMECHEAP, DOWNTIME, OR OTHERWISE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.
13. Indemnification
You agree to indemnify and hold harmless PounceDomains and its operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your bids and domain acquisitions, your content, or your violation of these Terms or any law or third-party right.
14. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, create risk or legal exposure, or if we discontinue the Service. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.
15. Changes to the Service or these Terms
We may modify the Service or these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, provide additional notice. Your continued use after changes take effect constitutes acceptance.
16. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules. You agree that any dispute will be resolved in the courts located in that jurisdiction, and you consent to their personal jurisdiction, except where applicable law gives you the right to bring claims elsewhere.
17. Miscellaneous
These Terms, together with the Privacy Policy, are the entire agreement between you and PounceDomains regarding the Service. If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
